THERASNAP TERMS OF SERVICE

1. ACCEPTANCE OF TERMS
By accessing or using TheraSnap (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you disagree with any part of these terms, you may not access the Service.
2. DESCRIPTION OF SERVICE
TheraSnap is a HIPAA-compliant application designed for mental health professionals to:
• Record voice memos and dictation AFTER therapy sessions conclude
• Convert your voice dictation to structured clinical notes using AI
• Store and manage client information securely
• Generate progress reports and documentation
IMPORTANT: TheraSnap is designed for therapist dictation and voice memos recorded AFTER sessions end, not for recording actual therapy sessions with clients present. While the app includes recording functionality, it is intended for YOU (the therapist) to dictate session summaries and clinical observations after your client has left.
3. ELIGIBILITY
You must be:
• At least 18 years old
• A licensed mental health professional or trainee under supervision
• Authorized to practice in your jurisdiction
4. ACCOUNT RESPONSIBILITIES
You agree to:
• Provide accurate registration information
• Maintain the confidentiality of your password
• Notify us immediately of unauthorized access
• Accept responsibility for all activities under your account
5. HIPAA COMPLIANCE
5.1 Business Associate Agreement
By using TheraSnap for protected health information (PHI), you agree to our Business Associate Agreement (BAA).
5.2 Your Responsibilities
You must:
• Comply with all applicable privacy laws
• Use appropriate safeguards for PHI
• Report any breaches immediately
• Handle all voice memos and notes as PHI
6. ACCEPTABLE USE
6.1 You MAY Use TheraSnap To:
• Record voice memos and dictation AFTER sessions end
• Dictate session summaries and clinical observations
• Create structured clinical notes from your dictation
• Manage client records and documentation
6.2 You May NOT:
• Use the Service for any illegal purpose
• Share login credentials
• Attempt to breach security measures
• Use the Service to harm minors
• Upload malicious content
• Reverse engineer the Service
• Use automated systems to access the Service
• Circumvent recording time limits
7. RECORDING USAGE AND LIMITATIONS
7.1 Intended Use
TheraSnap’s recording feature is designed for:
• Post-session voice memos dictated by the therapist
• Clinical summaries recorded after clients have left
• Brief documentation notes (time-limited to prevent full session recording)
7.2 NOT Intended For Client Session Recording
• TheraSnap is NOT designed or intended to record therapy sessions with clients present
• Recording time limits are in place to discourage recording of full therapy sessions
• We strongly recommend against using TheraSnap to record actual client conversations
7.3 If You Choose To Record Client Sessions
If you disregard our recommendations and use TheraSnap to record actual therapy sessions with clients:
• You are SOLELY responsible for obtaining proper written informed consent from all clients
• You are SOLELY responsible for complying with all state and federal recording laws
• Some states require two-party consent (California, Florida, Pennsylvania, etc.)
• You assume ALL legal liability for such recordings
• TheraSnap disclaims all responsibility and liability for unauthorized or illegal recordings
• Violations of recording laws may result in criminal or civil penalties
8. AI-GENERATED CONTENT
8.1 Accuracy
AI-generated notes are tools to assist documentation. You must:
• Review all AI-generated content for accuracy
• Make necessary corrections before finalizing
• Not rely solely on AI output for clinical decisions
• Verify transcription accuracy, especially for complex clinical terms
8.2 No Medical Advice
TheraSnap does not provide medical advice. All clinical decisions remain your professional responsibility.
9. SUBSCRIPTION AND BILLING
9.1 Free Trial
• New users receive a 5-day free trial
• Includes 48 AI conversions per month
• No credit card required
• Automatically converts to free tier after expiration
9.2 Paid Subscriptions
• Billed monthly or annually
• Automatic renewal unless canceled
• Prices subject to change with 5-day notice
9.3 Refunds
• Monthly plans: No refunds for partial months
• Annual plans: Pro-rated refund within 30 days
10. DATA OWNERSHIP
10.1 Your Data
You retain ownership of:
• Client information
• Voice recordings and dictation
• Clinical notes
10.2 License to Us
You grant us a limited license to:
• Process your data to provide the Service
• Create anonymized aggregate statistics
• Improve our AI models (with de-identified data only)
11. TERMINATION
11.1 By You
You may terminate by:
• Canceling your subscription
• Requesting account deletion
• Stopping use of the Service
11.2 By Us
We may terminate for:
• Violation of these Terms
• Non-payment
• Illegal activities
• Extended inactivity
• Misuse of recording features
11.3 Effect of Termination
Upon termination:
• Access to the Service ends immediately
• You may export your data within 30 days
• We will delete your data after 90 days
12. DISCLAIMERS
THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
WE SPECIFICALLY DISCLAIM ALL LIABILITY FOR:
• Misuse of recording features to record client sessions without proper consent
• Violations of state or federal recording laws
• Errors or omissions in AI-generated content
• Service interruptions or data loss
13. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THERASNAP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
• Damages arising from unauthorized recording of client sessions
• Legal penalties from recording law violations
• Professional disciplinary actions
• Errors in AI-generated documentation
14. INDEMNIFICATION
You agree to indemnify and hold TheraSnap harmless from any claims arising from:
• Your use of the Service
• Violation of these Terms
• Violation of any rights of another
• Unauthorized or illegal recording of client sessions
• Failure to obtain proper consent for recordings
• Violations of state or federal recording laws
15. GOVERNING LAW
